Pre-Sale Agreement for the Transformational Catapult on AKDMI Online Platform

This Pre-Sale Agreement ("Agreement") is made between AKDMI ("Company") and the purchaser of the pre-sale program ("Customer"). By purchasing the pre-sale the on-line service called Transformational Catapult ("Program"), the Customer agrees to the following terms and conditions:

1. Purpose:
The Customer is purchasing a pre-sale of the Transformational Catapult ("Program"), which is currently under development.
This pre-sale allows the Customer to gain early access to the development and to benefits listed on  section 3 "Pre-Sale Purchase Terms".
This pre-sale allows the Company to gauge market demand and secure initial funding for the completion of the Program.

2. Program Description and delivery:
The Program will be an online, self-experienced entity covering the following scope:
It’s well known that skills and intelligence can be developed through experience, practice and effort.
Individuals with developed Transformational Skills see challenges as opportunities to grow and improve. They embrace setbacks as part of the learning process and persist in the face of obstacles.
With the Transformational Catapult, children are more likely to take on challenges, learn from their mistakes, and ultimately reach their full potential.
The Transformational Catapult Program allows children to experience and practice Actions that foster Transformational Skills like: Critical Thinking, Creativity, Curiosity, Adaptability, Problem-Solving, Collaboration, Resilience, Empathy, Communication, Self-Motivation, Visionary Thinking, and Gratitude.

The Company is responsible for:
Developing the Actions and provide them by the on-line platform or any other means necessary, from the Company's point of view, to perform the Actions.
Do the best of their efforts to provide Actions for experiencing one skill while reinforcing other skills, to create a more holistic experiencing environment.
Provide a “digital feedback form” for the Client to give feedback on the Actions performed by the child.
Follow up constantly the efforts and experiences of the child-parent account received by the “digital feedback form”.
Provide graphically the experience evolution for each Transformational Skill. Starting from “Experiencing”, ending in “Experienced”.
Provide suggestions for encouragements and recognitions that are aligned with the intention of the Program.

The Client is responsible for:
Making the effort to make the child practice and experience those Actions.
Encouraging the child constantly and recognizing the effort made by the child.
Giving feedback to the Company, using the “digital feedback form” provided by the company, every time an action is concluded.
Maintaining a growth mindset with the child during the validity of the subscription to the program.

Expected delivery of the Program is 10 to 12 months.
The program will be developed and delivered in three phases as follows:
Phase One:
Scope: The first set of Actions will be released for the 4 Starting Transformational Skills.
Date: 31. Oct. 2025
Phase Two:
Scope: The first set of Actions will be released for the 4 Strategical Transformational Skills.
Date: 31. Dec. 2025
Phase Three:
Scope: The first set of Actions will be released for the 4 Catapulting Transformational Skills.
Date: 31. Jul. 2026
Other sets of actions may be developed if the Company considers it necessary.
Access to the Program will be provided through the AKDMI online platform.

3. Pre-Sale Purchase Terms:
The pre-sale price includes the following benefits:
- Five years access (counted from the launch of phase one),
- updates,
- all bonuses given by the Company during five years,
- one time free year-subscription for a sibling, valid during the five years of access.
The pre-sale price is 1,500 USD (One Thousand Five Hundred American Dollars), which reflects a discount from the full price of five continuous years of usage upon launch.
Payment is due at the time of purchase.
The pre-sale price is final and non-negotiable.
Payment is required at the time of purchase.
By completing your purchase, you are agreeing to the payment and terms outlined on this Pre-Sale Agreement.

4. Development Timeline and Updates:
The Company commits to begin development of the Program after a minimum of two thousand (2,000) pre-sale purchases.
The Customer will receive regular updates on the progress of the Program’s development via email or on the Company’s website.
The Program will be developed and launched in three phases, the launch of Phase One is considered as a compliant delivery date.
The Company reserves the right to adjust the development timeline as needed and will inform the Customer of any adjustments, via email or on the Company’s website.

5. Refund and Cancellation Policy:
Refunds:
We aim to deliver the Program as specified in 2. (Program Description). While we will make every effort to meet this deadline, delays may occur. If the Phase One of the Program is not delivered after 3 months of the expected delivery date, the Customer is entitled to a full refund.
The Customer is entitled to a full refund if the Phase One of the Program is not delivered by 30. Nov. 2025.
In the event of late delivery, Clients may request the corresponding refund within the 10 working days after the new delivery dates have been published by the Company in the official website.
If Clients don't request a refund, it is understood by both parties that the new Delivery dates are accepted, renouncing any right of refund from previous delay.
Partial refunds will apply if the company does not deliver all of the committed Phases of the program. Each phase has a value of one third of the full Program cost, and refunds will be calculated accordingly.
After delivery of each of the phases, respective refunds don't apply anymore.
In the event the Company decides not to proceed with the development of the Program or to postpone it, the Customer is entitled to a full refund.

Cancellations:
Pre-sale purchases may not be canceled after seven (7) days unless the Program is canceled by the Company.
If the Client decides to cancel within seven (7) days after purchase, the company will provide a full refund after the administrative work is done and credited accounts are confirmed by the Customer.

Refunds will be made in no more than 10 working days after Customer confirmation.

6. Access to the Program:
Upon completion of the Program, the Customer will receive access credentials via email.
The Program is for personal use only (one adult and one child) and may not be shared, copied, or resold.
The Customer acknowledges that the Company owns all intellectual property rights to the Program materials.

7. Non-Disclosure of Early Content:
Customers may receive early access to certain Program materials during the development phase.
By purchasing the pre-sale, the Customer agrees not to share, disclose, or distribute any early access materials except with the members of his direct family.

8. Risk Acknowledgement:
The Customer understands that they are purchasing a product that is not yet completed. The development timeline is subject to change, and the final Program content may differ from initial descriptions.

9. Liability Limitation:
The Company is not liable for any damages arising from delays, development changes, or non-completion of the Program beyond providing the refunds stated in section 5 (Refund and Cancellation Policy) of this Pre-Sale Agreement.

10. Termination:
This Agreement may be terminated by either party if the other party breaches any material term of this Agreement.
Upon termination, the Customer's access to any pre-sale materials will be revoked, and no refunds will be provided for partial or completed development stages.

11. Miscellaneous Governing Law:
This Agreement shall be governed by the laws of the State of Fribourg, Switzerland.

12. Entire Agreement:
This Agreement constitutes the entire agreement between the parties regarding the pre-sale of the Program.
Upon Program completion, a new agreement will be published in our Terms and Agreements web section.

13. Modifications:
The Company reserves the right to update this Agreement. Customers will be notified of any changes via email or the website.
By purchasing this pre-sale Program, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this Agreement.
Global Privacy Policy

Welcome to the AKDMI, AG., (hereinafter, “Transformational Catapult,” “Catapult,” “Company,” “us,” “our,” or “we”) EU & Swiss Privacy Policy (the “Policy”), we respect and protect the privacy of visitors to our website, www.catapult.ch, and the other websites under the catapult.ch domain (collectively, the “Sites”), and our customers who use our SaaS product, tools, and related services (together with the Sites, the “Platform”).This Global Privacy Policy (“Policy”) explains how we collect, use, disclose, and protect visitors’ and users’ information as part of the Platform. EU & Swiss Privacy Policy

Welcome to the AKDMI, AG., (hereinafter, “Transformational Catapult,” “Catapult,” “Company,” “us,” “our,” or “we”) EU & Swiss Privacy Policy (the “Policy”). This Policy governs how Catapult processes the Personal Information of individuals located in the United Kingdom ("UK"), European Union (“EU”), European Economic Area (“EEA”), and Switzerland (collectively, the “Data Subjects”) that are visiting our website, www.catapult.ch, and the other websites under the catapult.ch domain (collectively, the “Sites”), or are Customers who use our SaaS product, web design software, tools, and related services (together with the Sites, the “Platform”).
This Policy explains how we collect, use, disclose, and protect Data Subjects’ information as part of the Service in accordance with data-protection laws in the UK, EU, EEA, and Switzerland (collectively the “Data Protection Laws”).
